California Gun Confiscation Bill Passes

Last week California legislature passed SB-140 titled Firearms: prohibited persons. The bill approves $24 million to expedite the confiscation of the estimated 40,000 handguns and so-called “assault weapons” illegally owned by Californians. So what illegally possessed firearms are they confiscating, exactly?

The bill text, in rare form, is actually pretty easy to read and understand. I know, shocking right? At any rate, the bill is all about funding. The bill “allows the Department of Justice to utilize additional Dealers’ Record of Sale Special Account funds for the limited purpose of addressing the current Armed Prohibited Persons System (APPS) backlog” to confiscate firearms from individuals that are listed in APPS.

APPS?

So what is APPS, and how do you get listed in the system? For those of you who don’t live in California, here you go:

Established in 2007, APPS cross-references criminal, domestic violence restraining order and mental health history records, among other prohibited category data, with records of all handgun owners and assault weapon and .50 BMG rifle registrants in the state on or after January 1, 1991, to identify those persons who have subsequently become prohibited from owning or possessing firearms.

So essentially, a fee that Californians pay when they purchase a firearm (called a Dealer Record of Sale fee) is being used to fund the confiscation of firearms of people who find themselves listed in APPS.

I’m not a big fan of this program or SB-140, not by a long shot, but it’s important to keep things in perspective, especially when it seems like politicians are coming after our guns every time we turn around. This isn’t flat out firearms confiscation.

That isn’t to say that this program is harmless, because it’s not. Now that the program has funding, I think it provides a framework that will absolutely be abused and used to take away firearms from law-abiding citizens, the only question is when. The biggest risk I see in the short term is the system being used to take away firearms from veterans who have been diagnosed with PTSD.

Let’s all hope that California isn’t that stupid.

In the case of veterans than yes that is outrageous for them to take the firearms from PTSD patients if they are handing them right..

        As someone who lives in the state and understands what is going on, it is BULLSHIT! The DROS fee laws were set in place to cover the upkeep of the DROS system. If there’s a 25 million dollar surplus in the DROS account then that means that Californians have been overcharged since the beginning of the DROS system so the DROS fees needs to drop significantly to balance the account. Do I agree that criminals need to have their guns confiscated? Of course I do but it needs to be funded from the General Account from the state so that everyone in the state bears the burden of keeping guns out of a criminals hand. Why should it only be gun owners who bear the burden for the rest of the state? We want bad guys to not have guns just as much as the anti gunner wants bad guys not to have guns.

          Anyone who actually believes they can take guns from the hands of ONLY the criminals are delusional! Criminals dont buy guns from gun stores, they get them by robbing, stealing, and buying them from other criminals! If everyone had guns, the stupid criminals wouldnt stand a snowballs chance in hell of of getting away with such behavior! ~ Would you rob someone if you knew that EVERYONE around you (in their homes AND on the streets) was armed? The number of IDIOTS would decline sharply! Make the penalty for “gun crimes” tougher, NO EARLY RELEASE FOR GOOD BEHAVIOR! And we know that the police wont show up until you are already dead! And who came up with the plan to use the money in the DROS system to fund this fiasco?             The idea was put out there by the piece of shit in San Francisco. Nobody want’s it and gun owners deserve a refund for being raped in DROS fees. I understand the whole point of criminals don’t buy guns from gun stores, but the APPS system is designed to go after those who were once law abiding citizens turned criminals.

        Its not brain surgery, if you could get the guns away from the criminals I would agree with it, BUT if you really think you will then you are going to badly mistaken… There is no way you will ever take guns away from criminals, they will find a way to get them all they are doing is making it easier for the criminal to commit crimes because there will be no defense out there. Just like making them illegal, they made drugs illegal and they are worse now than ever and there are new drugs on the market daily, drinking and driving is illegal and look how many die daily from drunk drivers. If you don’t want a gun don’t buy one, but make it a harder back ground check and finger prints and birth certificates or any way that it takes to make it harder to get guns but those of us that are legal and of age leave us alone, I will defend myself and my family or die trying before I let anyone hurt them so I will carry as I do now every day, like it or not!!

        Why is it outrageous? Because it is people in their 20’s or in their teens that have done all these mass killings. No one older has done this. Why? Because anyone older than that has figured out to speak up if their meds are making them insane enough to murder. Those younger are also probably on different meds that are more controlled by their parents. By 30 everyone basucally controls their own meds.

If they got shot in the head when they tried to rob people, there would be a lot less “SCUMBAGS” to be concerned about. Who wants to wait for a veteran to snap and hurt his self or another?         Hi, these bills (there are about 10 of them), will make my husband and I felons. We have never broken a law, and never aim to. We are parents. We pay taxes. And now we will be felons on multiple accounts. Please read all the bills the senate public safety commity of california passed late one night by a 5 – 2 majority. 5 people voted for sweeping legislation and confiscation that can apply to millios of californians. My husband has never been arrested nor ordained, but had his tattoos documented by the police at a music festival. He was doing nothing, but they made his leave, sit down on a curb, ask him questions, then let him go back inside. He is very law abaiding. He has a celtic cross tattoo. His mother is a policed officer. She looked him up, and in a data base it now lists him as a possible member of a criminal gang – which is not and has never been. Now, he will be a FELON on january 1st if we stay in Kalifornia when these bills go into affect, becasue you may not own a firearm if you ‘have disobedience to the terms of an injunction that restrains the activities of a criminal street gang’. If you can read, you will see this is obtuse and can be applied many ways. That is the actual text from one of the bills passed by 5 people. YOU HAVE TO READ WHAT YOU SUPPORT DUMMY!!!!

        You read the domestic violence part. That’s not a criminal… that’s 2 domestic partners getting mad and having neighbors call the police on them. restraining orders are when 1 takes out an order in the courts verse another. When I got divorced, my ex took out a restrainng order against me.. and we’d never even yelled at each other, much less got physical?.. it’s because her lawyer told her to do it… So theoretically any divorced person who had a spouse take a RO against them?… mental health history records… so anyone who ever went to a psychologist for ANY reason? stress disorders? I mean… that can be a very broad term.

    I have a huge issue with the domestic violence restraining order. Any divorced man knows an ex with an axe to grind can make up ANYTHING and cause you problems. After my ex got her restraing order Ex Parte, she then broke into my apartment twice. My offence, not having the money for a lawyer.

      i can 2nd that one. my ex came home drunk, me and the kids were sleeping, and she came in and jumped on the bed punching and kicking. When i got away from her i ran to the kids room and locked the door. She called police and said i beat her. NO marks on here and my face and body had marks on me. But because i was male and she was female, I was proven guilty till proven innocent. You just never know the truth unless you are the one living it. And yes an Ex parte is something a lawyer will tell the women to do to help the battle and they are hard to fight, no matter if they are for truth or not.

        It’s for autos with trailers , which is confusing wording in itself. Most of their interstate is 75, or 55 for autos with trailers. The I-10 is this way. It’s a money grab scheme!

    The State of California got caught with its fingers in the “surplus DROS fees” cookie jar and had to replace that source with legitimate funding. A fee by law cannot exceed the cost of administering the program for which the fee is collected…or else it’s a TAX.

    This is why registration, in ANY form is so inherently dangerous to our Second Amendment Rights. There is NO provision in the Second Amendment to deny ANYONE the RIGHT to possess a firearm. There is nothing in this legislation that will keep firearms out of the hands of violent criminals, who re-offend time & time again. Yet, in California, it is the law of the land
    What angers me the most, gun owners in California are now in the position of not receiving mental health assistance or losing their gun rights. Not only the Veterans, but the Police, Firemen, & other First Responders who face unimaginable terrors & horrors day in & day out. If they seek out Mental Health assistance then they too run the all to real risk of losing their Fire Arms RIGHTS. These are people who are more than likrly of NO danger to themselves, let alone anyone else.
    As we have already seen, if a family member living in the same home has any sort of Mental Health issues, then EVERYONE in that home loses their Second Amendment Rights. There appears to be little or no legal recourse. These are not people that have been declared of unsound mind by a competent Court, but based simply on their availing themselves to the help of a Psychologist or the opinion of some less than well trained mental health worker.

      No GUN has ever escaped from a gun store and killed one single person. Only when used by human beings is a gun capable of causing death. A gun cant load itself, a gun cant aim itself, a gun cant pull its own trigger, and a gun doesnt have a brain capable of complex thought! More people in the U.S. die from automobile accidents than guns. If it wasnt for guns, your “freedom” here wouldnt even exist. I guess `Merica failed history class. If you dont like it here you can move to europe too, the sooner the better. Need money for a “one way” ticket?     You fail to explain in the article that the DROS charges $35 per gun purchase to do a background check. That $24 million of extra money was taken from legal gun buyers/traders by over charging us for our background checks. Using this fund for anything but background checks goes against state law. The law (that they’re breaking) was designed to prevent hidden taxes created by over charging people for licenses, permits, & such – which is EXACTLY what they’re doing.

    Just waiting for one person to explain to me…and don’t hide behind the right to bear arms statement… Why does a law abiding person need an uzi or mack10 or any automatic weapon. I have no problem with guns, having owned many in my 50+ years, but seriously, I don’t think the right to bear arms ever intended it to include automatic assault weapons etc. This is a case where the law is a little outdated and needs to be revised to catch up to the times. Remember, this law was put on the books over 100 years ago when ALL guns could only fire one shot at a time, not like ARs and AKs which can now fire in excess of 2600 rounds per minute. Common sense should apply.

      The right to bear arms was intended to mean the same weapons used by the common soldier, and the Supreme Court agrees.

      In United States v. Miller, 307 U.S. 174 (1939), the Supreme Court ruled that the [Second] amendment “[protects arms that had a] reasonable relationship to the preservation or efficiency of a well regulated militia”.

      An unmodified AR-15 is not fully automatic, but if it were could only fire 800 rounds per minute. As a semi auto rifle it is only really capable of effectively shooting 50-60 rounds per minute. Reality should apply!

      The second amendment was clearly written as a way to keep our Govt. in check. Currently, If we had to fight against our Govt. for our freedoms we would be severely outgunned.

      Far more people are killed each year with hand guns than are killed with Semi Automatic rifles! Why would our Govt. focus so heavily on the rifles and magazine capacity?

      For that matter, far more people are stabbed or beaten than are shot. which is a trend that will likely be worse in an unarmed society.

    Why evey time I hear PTSD it’s only mentions Veterans? What about cops, firefighters, car accident victims, rape victims, and yes even mothers who had a traumatic birthing experience. They too can exhibit PTSD symptoms, but it’s US veterans who get labeled and people freak out because they don’t understand what it is.

      S.S in “Rambo” being a big influence, with less then 1% of Americans serving the civilians don’t understanding what we do except what they see on TV that and lets face facts a woman that has had a tramatic birthing isn’t as big a threat as a a well trained military member with combat deployment.

    Iceman, in theory, it sounds like a good idea but what would prevent them from coming to your house, calling you “illegal owner” and taking what you got? What would prevent them from broading the search to include certian aged people just because of their age? What makes you think the criminals who have them actually bought them at a store and have a paper trail to follow? What makes you think it will stop or prevent anything?…..other than more crime. California, Chicago, New York have two things in common…they have the strictest gun laws right now but they also have the highest crime rates!
