Florida Second Amendment Preservation Act

Florida Rep. Dan Eagle (R-Cape Coral) introduced HB733 on Monday, a bill designated the Second Amendment Preservation Act.

Federal Regulation of Firearms: Designates act as “Second Amendment Preservation Act”; provides legislative findings; prohibits specified actions to enforce certain federal regulations of firearms & ammunition; provides for loss of position or office of agent or employee of state who violates prohibition.

Reading through the text of the bill, it’s clear that the bill would effectively nullify all federal gun laws by making it illegal to enforce such laws. Rep. Eagle said the following about the Second Amendment Preservation Act.

The Tenth Amendment to the United States Constitution expressly provides that all powers not delegated to the federal government are reserved to the states. Time and time again, Florida has proven that we have the best solutions to our own issues, whether it be healthcare, education, or our balanced budget, which is accomplished without raising taxes. When it comes to protecting our fundamental Second Amendment rights guaranteed by the Constitution, I believe it is best left to be handled by Floridians for Floridians.

    Well said. They realize that the power needs to remain where it should be, in the hands of the States. I appreciate their stance and wish more States had the guts to follow suit.

    Wish I lived there. Having said that I’ve pointed out on here before that laws are just words on paper. As Stalin said it isn’t what’s written on paper that counts. But rather who has the power to enforce (or ignore) the laws that matter.
