Senate Filibuster Fails

Today the Senate voted 68-31 to start debate on gun control legislation that includes expanded background checks and new penalties for gun trafficking. Sixteen Republicans joined with 50 Democrats and two independents to let the bill proceed, while 29 Republicans and two Democrats (Sen. Mark Pryor, D-Ark., and Sen. Mark Begich, D-Alaska) voted to block it.

Background Checks

What is still unclear to me is exactly how background checks would be changed by the newly proposed amendment. Fox News reports, emphasis added:

The amendment likely to be at the front of the line is one from Sens. Joe Manchin, D-W.Va., and Pat Toomey, R-Pa., which would scale back the call for universal background checks. The plan would expand checks to gun-show and Internet sales, but exempt certain personal transactions.

I’m still waiting to see the text of this amendment, because based on that description it’s not clear how background checks will be changed. As many of you already know, buying a gun from a dealer at a gun show is no different than buying a gun at a gun shop – the exact same background check procedure is followed. I’ve purchased many firearms at gun shows (back when the prices were good) and there is literally no difference.

The “loophole” that the anti-gun crowd talks about is the private transactions that take place at gun shows. But every description I find of the above amendment says that certain personal transactions will be exempted, which is more or less what we have today. There’s got to be something more than what we’re hearing.

Based on this new amendment, and the 68-31 vote today, it’s looking more and more likely that something will pass out of the Senate.

What’s in the final package still remains to be seen.

This is the really sad part, “Yet, as of this morning, not a single senator has been provided the legislative language of this provision.”
